So, as is now pretty much a known fact, the September Not-a-Reboot-but-a-Relaunch (or "NottaBoot" if you will) is a direct result of the Siegel Family lawsuit.

But Supes ain't the only character they could go after by a long shot, if they so desired...

Matter-Eater Lad would be the biggest loss to LSH-dom of course, but if those money-hungry Siegel lawyers get wind of the rabid LSH fanbase, we stand to lose many more:

Invisible Kid

Have I missed something here, is the relaunch really being linked to the court case? I can't see how taking Superman back to the way he was in the Siegel/Shuster days (in the new Action Comics at least) can help DC.

Copyright was extended a lot of times. It was once 56 years, then 75 years, then 95 years.

When copyright was extended, it was written into the law that if you sold your copyright before the law extended it, you only sold the original amount, not the extension. So the Siegels sold Superman when the length was 56 years; when the length was extended, they got to keep the 56-95 year extension. The Shuster heirs got to keep the 75-95 extension (they couldn't get back the part from 56-75 because the rules for that one didn't apply to all heirs).

The law only applies when the copyright was sold. If you did a "work for hire", it's considered to have been created by the company in the first place, not to have been sold, so Legion characters aren't eligible. Superman became an issue because they created Superman first and then sold him, rather than creating Superman as a DC employee.

And they're no more being greedy by wanting the extensions than DC is by wanting the extensions. DC didn't earn them any more than anyone else; DC was sold 56 years and they got 56 years. Any years past 56 are an unearned gift; it's just a question of whether DC or the families of the creators get the gift.

I wanted a "J" name that sounded like someone young, so I chose Josh.

This thread wasn't meant to be serious, I doubt the Siegel family has any actual interest in the LSH.

And if there really IS a Josh Siegel grandchild in the Siegel family, I'm sure he's very nice [Smile]

I simply can't wrap my mind around the fact that these two people who had nothing to do with SUPERMAN get annual pensions from DC...????

Heirs are heirs, I assume it's as simple as that. If a man was entitled to something, it goes to his estate when he's gone, and estates go to heirs. It's not a question of whether the heirs contributed somehow.

Wife and kids probably had nothing to do with Superman either if that were a legal point.

(Alright, I think she might have been the original model for Lois...)

The agreement they are hinging the ruling on says that they pay Shuster's sister 25K a year until she dies. Once she's gone DC will supposedly own the Shuster half of the rights in perpetuity (or until Congress grows a backbone and lets them go into Public Domain).

Not actually reading anything about this, but just tossing out possibilities to ease Lash's mind:

If anyone's fighting over something right now, fair chance it's what the wording of some previous settlement or other agreement means, not what the general rule of law is. It's not as if every creator automatically gets his or her siblings and grandchildren a pension.

ERB's estate is an interesting case as a lot of Burrough's characters and stories ARE in Public Domain in most jurisdictions, and it's just Trademark, not Copyright they can legitimately claim. Of course that doesn't stop them from saying they have the rights. It will be interesting to see if the spat with Dynamite goes all the way, as it may set precedent if a judge is forced to rule on the question of trademarking something you don't own copyright to. That is, how much of a Public Domain property can qualify as a "mark".
