Oh, that was in Unexpected Prison Tales #13 from ACG
Horn was secretly the villain Hornblower and Dyce went into prison to not only get the name of the criminal mastermind who hired him, but to a young lady who had been wrongly convicted for a crime. If Dyce could only get someone inside to confess to the crime, she would be free.
Dyce, as Hornblower, got a lot of blowing practice during his time in prison, as you can imagine. What with it being the Christmas issue and Horn being in both the choir and the band. But although he got information on the Mastermind, the evil Mr Toboggan, he couldn't save the young lady from execution.
From that day Dyce saw the lottery of justice. He embodied that into a pair of dice. He would roll the dice when he defeated a villain, with the number equating to their grisly fate. Daniel Dyce became the Diceman.
An additional bit of comics history: Issue 14 of Unexpected Prison Tales was heavily rewritten at the last minute. The publisher had put in a Diceman poll. In it, youngsters could write in with their favoured forms of execution for each die roll result. As the Diceman strip referred to the poll as a marketing gimmick, it had to be pulled too.

Hint: These characters appeared in a comic that was not originally published by DC Comics, though has been *reprinted* by DC Comics!
